Aaron Rubin is a leader in both transactional and compliance healthcare law. He represents a diverse group of clients in the healthcare industry from skilled nursing facilities to management services organizations, third-party medical billing companies, x-ray companies, therapy groups, individual therapists,and other health care providers and facilities throughout New Jersey and New York. Aaron has an unmatched depth and breadth of knowledge and experience in sophisticated transactional, healthcare litigation, and compliance issues that healthcare providers face.
In healthcare transactional law practice, Aaron specializes in structuring and reviewing contracts and service agreements between health care providers, business associates, and vendors, all the while ensuring compliance with the extensive fraud, waste, and abuse regulations and specific service requirements imposed by federal and state laws and regulations. For example, Aaron represented a New York State Article 28 diagnostic and testing facility in both complex contractual negotiations with a local hospital, as well as with regard to federal and New York State regulatory issues.
Aaron also establishes management services organizations for healthcare businesses in both New Jersey and New York, such as physical therapists, occupational therapists, speech language pathologists, psychologists, mental health professionals, and veterinarians; thereby avoiding the prohibitions against fee splitting and the corporate practice of medicine. Aaron has assisted in creating and structuring a group purchasing organization (GPO) to meet business expectations, as well as to comply with the relevant federal Anti-Kickback Safe Harbor. Aaron has also aggressively and successfully represented providers in fee disputes with insurance companies and third-party administrators. In-depth knowledge of the laws and regulations relating to healthcare providers coupled with a thorough understanding of the business realities facing providers enables Aaron to effectively advocate for clients. In his healthcare compliance practice, Aaron is in constant contact with clients, advising them on a whole range of issues such as billing practices, including percentage based payments, coinsurance, deductibles, and copayments; standards under the Fair Labor Standards Act and related state laws and regulations; Anti-Kickback; Stark; fee-splitting; HIPAA; HITECH; and medical device laws and regulations. Aaron drafted copious policies and procedures and related audit tools to meet and exceed both federal and state corporate compliance program requirements as mandated under the Patient Protection and Affordable Care Act and applicable state specific laws and regulations. Aaron does not simply hand his clients a mound of papers to read; rather, he personally assists clients in establishing, implementing, and administering compliance programs that seamlessly integrate with existing operational and organizational structure of the client’s healthcare entity. Moreover, ever cognizant of the increasing governmental oversight in compliance matters, Aaron personally trains his clients’ governing board members, compliance officers, and compliance committee members in regulatory and compliance related matters, risk management, governmental and third party billing and reimbursement, licensure and certification, survey and enforcement, physician employment and recruitment arrangements, and medical provider-vendor contracting. If any issues arise, Aaron personally interacts with both federal and state government regulators on behalf of his clients and advocates for his clients’ best interests. He has successfully assisted clients in completing government compliance audits and helped them avoid disciplinary actions and fines thereby saving his clients valuable time and money. Aaron is also an expert in guardianship proceedings for incapacitated persons both before the Superior Court of New Jersey and before the New York Supreme Court in Article 81 guardianship proceedings, and has appeared before judges in numerous counties throughout New Jersey and New York. Among Aaron’s successes, he successfully represented and defended a client before the New York State Office of Professional Discipline in an investigation related to alleged “holding out” and fee splitting. He has also researched and drafted legal briefs for Medicaid Fair Hearings, and has successfully prosecuted collections lawsuits on behalf of his clients. Marc specializes in representing health care providers throughout New York and New Jersey to assure continuity of payment and reimbursement through the use of Medicaid applications and appeals, guardianships, estate litigation and administration, general civil litigation, and various other remedies. He has appeared on behalf of his clients in numerous counties throughout the entire New York State.
Marc has extensive experience in representing nursing homes in Mental Hygiene Law Article 81 Guardianship proceedings. He handles a diverse array of proceedings on behalf of his clients in resolving accounts receivables issues and maintains an aggressive and creative approach in utilizing a broad range of legal remedies to obtain relief for his clients.
Prior to joining the firm Marc served as in-house counsel for a tech start-up, drafting its terms of use and privacy policy as well managing its other legal concerns, before shifting his focus to the healthcare sector and serving as the chief compliance officer for a mobile diagnostics provider.
Marc received his Juris Doctor from Fordham University School of Law (2012) and is admitted to practice in New York and New Jersey.
